Eligibility Criteria for Spousal Sponsorship
You are eligible as a sponsor if:
– You are at least 18 years of age
– You are a Canadian citizen, permanent resident in Canada, or if you’re registered under the Canadian Indian Act
– You live in Canada or you’re a Canadian citizen abroad who is planning to return to Canada
– You are not receiving social assistance for any reason other than for a disability;
– You are independent, meaning you can provide for the basic needs of yourself, your spouse/partner, and any dependent children.
Sponsors must be able to support their partner financially without depending on social assistance.

Spousal Sponsorship Requirements
As previously stated, sponsors must be able to provide complete financial support for the basic needs of the sponsored person and any dependent children from either party. Sponsors are required to sign an undertaking agreeing to this commitment.
Basic needs include:
– Housing
– Utility Bills
– Food
– Personal Hygiene Products;
– Clothing
– Daily essentials/necessities
– Any medical expenses not covered by public health insurance (including eye care and dentistry)
The established sponsorship obligations begin immediately upon signing the undertaking and last for exactly 3 years from the day your partner receives their permanent residency.
* Undertakings cannot be canceled or withdrawn once an application has been approved by the IRCC.
Income requirements to sponsor your spouse or partner
While there are no specific income requirements to sponsor a partner, financial preconditions for spousal sponsorship do include a sufficient income and the necessary assets to support your spouse once he or she arrives.
* Note that sponsorship is not possible during bankruptcy proceedings or while receiving government support, except in the case of disability benefits.

How to Apply
After ensuring both you and your spouse meet the eligibility requirements, it’s time to submit the relevant applications. Two applications need to be submitted simultaneously:
– Your application for your spouse/partner
– Their application for permanent residency
The sponsorship application is essentially a four-step process”
1. First, complete the official application package which contains the required instructions to complete the process.
2. Pay the online application and processing fees.
3. Submit your application by following the instructions given in the guide
4. Submit the completed documents requested in the application package.
The processing time generally takes around 12 months. Spousal sponsorship applications can generally be submitted either at an immigration office or in the case the sponsor is living or traveling abroad, at a visa office.
Some restrictions apply in the case of conjugal partners.
The process itself is fairly straightforward, however, there is a significant amount of documentation to complete, and it’s important to ensure that forms are filled out correctly. Errors can result in delays and even application denial.
Some people elect to complete the application procedure without legal assistance. While this is possible, it’s not recommended. Bringing your significant other to Canada is important, and due to the associated processing time, it’s better to avoid risks.
Applications may be refused or denied if:
– They were errors or inconsistencies in any of the forms of documents
